Terms and Conditions

General

Paintings DO NOT come framed, they will be on a gallery wrapped canvas. Side profile depth is 1-1/2" If you would like your canvas framed with a floating frame (Floater frames do not have a front lip around the artwork, canvas gets attached to the back) see "add-ons" from pricing menu.

Fees

A non-refundable 50% retainer is required prior to the creation of custom artwork. Final payment is required before final delivery. No artwork will be delivered before payment is paid in full.

Cancellation

Any order can be cancelled before it enters production or supplies are purchased.
If your order has already entered production the non-refundable 50% will be retained.
All complete orders are non-refundable.
Shipping costs are non- refundable if your order has already been shipped.
Non-customized products can be returned at your cost. To receive a refund product has to be returned unopened, unused and undamaged. In case the product has been damaged or opened a there will be no refund.

Artist's Right to Authorship Credit

Artist may use Work in Artist's portfolio (including, but not limited to, any website that displays Artist's works).
When asked, Client must properly identify the Artist as the creator of the artwork.
Client does not have a proactive duty to display Artist's name together with the artwork unless it is in a public place.
Client may not seek to mislead others that any artwork (originals or prints) was created by anyone other than Artist.
Artwork is not for resale in any commercial or personal sense without consultation and client will endure legal pursuit if attempt to reproduce is made.
All reproduction is prohibited, this included prints made by client of original artwork purchased.
Artwork may not be modified in any way. Artwork may not be cropped into individual elements. If interested in using individual elements, they can be purchased by request.
Copyright Ownership: Alicia Cox (Purple) owns all copyrights in any and all work(s) created or produced pursuant to federal copyright law (Title 17, Chapter 2, Section 201-02 of the United States Code), whether registered or unregistered. Any and all products, whether tangible or intangible, produced or created in connection with, or in the process of fulfilling this Agreement, are expressly and solely owned by Alicia Purple and may be used in the reasonable course of Vendor’s business

Relationship of the Parties

The parties agree that Alicia Purple is an independent contractor. No agency, partnership, joint venture, or employee-employer relationship is intended or created by this Agreement. Neither party is authorized to act as agent or bind the other party except as expressly stated in this Agreement.
Artwork or any other deliverables prepared by Alicia Purple shall not be deemed a work for hire as defined under Copyright Law. All rights granted to Client are contractual in nature and are expressly defined by this Agreement.
Artist remains the sole owner of each design

Creation

The manner and method of creating any artwork is solely at the discretion of Alicia Purple and the Client has no right to control Artist’s manner and method of performance under this Agreement. Artist will use his/her best efforts to: (a) ensure that the artwork conforms to Client’s specifications; and (b) delivery on or before the applicable deadlines.

Proofing

If any time, the job changes to an extent that substantially alters the specifications as described in the original estimate, we will submit a proposal revision memo to you and a revised fee will be will be agreed upon by both the client and Alicia Purple before moving forward with the object. Fees already paid may be retained separate.
